SSCA has made repeated and continuing efforts to enforce the 2021 Settlement Agreement.
Although many provisions have resulted in major improvements on the site,
SSCA believes that Hanapohaku continues to violate the spirit and letter of many other provisions of the Settlement.
SSCA has and will continue to monitor, dialogue, mediate, reveal, and bird dog these compliance problems.
One egregious example is the overflowing grease trap reported to DOH in December 2021, reportedly causing employees to slip and fall in the grease seeping on the ground.
This serious failure to maintain the wastewater treatment system resulted in Notice of Violation from the State Department of Health and fines for an "inoperable" wastewater treatment system, "active spilling," and "strong and continuous adverse odors."
Hanapohaku paid a $200 fine in Jan. 2022 and was required to enter into a maintenance contract for all wastewater treatment units.
